Art Off Queen a Derivative

Is making a derivative of a piece of public art ethical? If a piece of art is installed out side in a public area you can be pretty sure it will be photographed from every angle and in every natural lighting condition.

But what happens if the photograph of the art piece is transformed into a derivative is this still ethical?

I suppose that there is some twisted law such that says if you took the photo with one hand tied behind your back then whatever you do with the photo is quite alright by the laws of Canada.
